Your Data Protection Rights

We may update this Policy from time to time as we improve our current offerings and as technologies and laws change. You can determine when this Policy was last revised by referring to the “Last Updated” legend at the top of this page. Any changes will become effective upon our posting of the revised Policy.



1. INTRODUCTION


At divePRO S.A. ("divePRO"), we believe you should have control over your data. Regardless of where you live, we grant the following rights to all our users to ensure transparency and control over your personal information.

2. YOUR RIGHTS


You have the following rights regarding the personal data we hold about you:

The Right to Access (To be Informed): You have the right to request a copy of the personal data we store about you and to ask how we use it, why and for how long.

The Right to Rectification (Correction): You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete.

The Right to Erasure (Deletion / "Right to be Forgotten"): You have the right to request that we delete your personal data, subject to certain exceptions (e.g., if we are legally required to keep tax records or for warranty purposes). Upon deletion, your personal identifiers will be removed. However, as per our Terms of Service, anonymized and aggregated dive data (technical telemetry that cannot identify you) may be retained by divePRO for research and product improvement.

The Right to Data Portability: You have the right to request that we transfer the data that we have collected to another organization, or directly to you, in a structured, commonly used, and machine-readable format (e.g., CSV or JSON files).

The Right to Restrict Processing: You have the right to request that we restrict the processing of your personal data under certain conditions.

The Right to Object: You have the right to object to our processing of your personal data (e.g., for direct marketing purposes).

​​The Right to Withdrawal of Consent: If we are processing your data based on your consent (e.g., Newsletter subscription), you have the right to withdraw your consent at any time.

The Right to Lodge a Complaint: If you believe that we have infringed your rights, we encourage you to contact us first so we can try to resolve the issue. However, you have the right to lodge a complaint with your local Data Protection Authority.

Rights related to Automated Decision Making and Profiling: divePRO uses algorithms to analyze your dive data and provide health and performance metrics. You have the right not to be subject to a decision based solely on automated processing if that decision produces legal effects concerning you. divePRO clarifies that its automated analysis is for informational/recreational purposes only and does not produce legal or similarly significant effects.

Right to explicit Consent: Please note that processing of health-related data (such as heart rate) is based strictly on your explicit consent which you provide when setting up the Device. You may withdraw this consent at any time via the App settings.

3. HOW TO EXERCISE YOUR RIGHTS

​Your full name and the email address associated with your divePRO account.

​The specific right you wish to exercise (e.g., "Request for Deletion").

4. VERIFICATION PROCESS


For your protection, we must verify your identity before fulfilling certain requests.

Account Verification: We will typically verify your identity by asking you to log in to your divePRO account or by sending a verification code to your registered email.

Additional Proof: In some cases (especially for data portability or sensitive requests), we may ask for additional proof of identity to ensure we are not releasing data to an impersonator.

5. RESPONSE TIMING


We aim to respond to all legitimate requests within 30 days (GDPR standard). If your request is particularly complex or you have made a number of requests, it may take us longer (up to two additional months in accordance with applicable law), but we will notify you and keep you updated

6. AUTHORIZED AGENT


You may designate an authorized agent to make a request on your behalf. To do so, you must provide the agent with written permission to act on your behalf, and we may still require you to verify your identity directly with us.

Residents of the EEA, U.K., or Switzerland


  • If you are a resident of the European Economic Area (EEA), the United Kingdom or Switzerland, you possess all the data protection rights outlined in Section 2 (“Your Rights”) above.
  • For further information regarding your rights under the GDPR, you may visit the European Commission’s “My Rights” page relating to GDPR, which can be displayed in a number of languages.
  • To exercise any of these rights, or to lodge a complaint, please contact us at privacy@divepro.gr or at our registered address: divePRO S.A., Iroon Politechniou 1, Gerakas, 15344, Athens, Greece.
  • We may share your data with trusted third- party service providers (processors) who assist us in operating our Services, such as cloud hosting providers, payment processors and customer support tools. All such third parties are bound by strict confidentiality agreements.
  • Some of our partners and service providers may be located outside the EEA. Whenever we transfer your personal data outside the EEA, we ensure a similar degree of protection is afforded to it by implementing safeguards such as the EU Standard Contractual Clauses (SCCs).

Residents of the U.S.


  • If you reside in California, please visit our CCPA Privacy Notice to learn more about your privacy rights.
  • If you reside in any U.S. state with a comprehensive privacy law, you have a right to request access to and correction, deletion, or a portable copy of your personal data, and the right to opt -out of targeted advertising.
  • If you live in a state with a consumer health data privacy law, information on our collection, use, and disclosure of consumer health data (such as heart rate data and related metrics) can be found in our Privacy Policy section.
  • Under California Civil Code Section 1798.83, California residents may request and obtain from us, once a year and free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year.
  • You have the right to direct us not to "sell" or "share" your personal information to third parties for cross-context behavioral advertising. You can exercise this right via the "Do Not Share My Personal Info" link on our footer.
  • We will not discriminate against you for exercising any of your data protection rights. Unless permitted by law, we will not deny you goods or services, charge you different prices or rates for goods or services or provide you a different level or quality of goods or services.

  • You may contact divePRO S.A. at any time with questions related to these rights or to appeal in the event that we have denied a request to exercise your rights, by emailing privacy@divepro.gr. Depending on your request, we may require you to take steps to verify your identity, such as requiring you to log in to your account or, in the event an authorized agent makes the request on your behalf, we may provide you with instructions on how to confirm the agent's authorization.
