NOTICE FOR CALIFORNIA RESIDENTS (CCPA/CPRA)

This Notice for California Residents supplements the information contained in the divePRO Privacy Policy and applies solely to visitors, users, and others who reside in the State of California ("consumers" or "you"). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and the California Privacy Rights Act of 2020 (CPRA).
1. CATEGORIES OF PERSONAL INFORMATION WE COLLECT
In the preceding 12 months, divePRO S.A. has collected the following categories of personal information. We obtain this information directly from you, from your devices (divePRO Device), and from third-party partners.

Retention Criteria: We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, including for the duration of your account lifespan, plus a reasonable period to comply with legal/tax obligations.
2. SHARING OF PERSONAL INFORMATION
divePRO may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to keep that personal information confidential.
In the preceding 12 months, we have disclosed the following categories of personal information for a business purpose (e.g., to cloud providers like AWS, payment processors like Stripe, or customer support tools):

- Category D (Commercial Information)
- Category E (Biometric Information - stored securely for your use)
- Category G (Geolocation Data)
3. SALE OR SHARING OF PERSONAL INFORMATION
Under the CCPA, "sell" and "share" are broadly defined and include sharing data with third-party advertising networks (like Meta/Facebook or Google) for cross-context behavioral advertising.
- We DO NOT sell your sensitive health or biometric data (Category E) or your precise dive logs.
- We MAY "share" internet activity (Category F) and identifiers (Category A) with advertising partners via cookies and pixels to show you relevant ads.
4. YOUR RIGHTS AND CHOICES
As a California resident, you have specific rights:
- Right to Access (To know): You can request that we disclose certain information to you about our collection and use of your personal information over the past 12 months.
- Right to Erasure: You can request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.
- Right to Correct: You can request that we correct inaccurate personal information.
- Right to Opt-Out of Sale/Sharing: You have the right to direct us not to sell or share your personal information for advertising purposes.
- Right to Non-Discrimination: Businesses cannot deny goods or services, charge you a different price, or provide a different level or quality of goods or services just because you exercised your rights under the CCPA.
- Right to Limit: You have the right to limit the use and disclosure of sensitive personal information that is collected about you.
