WARRANTY POLICY

We may update this Policy from time to time as we improve our current offerings and as technologies and laws change. You can determine when this Policy was last revised by referring to the “Last Updated” legend at the top of this page. Any changes will become effective upon our posting of the revised Policy.
1. INTRODUCTION & SCOPE
THIS WARRANTY POLICY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER LEGAL RIGHTS, WHICH VARY FROM STATE TO STATE (OR BY COUNTRY OR PROVINCE). DIVEPRO DOES NOT EXCLUDE, LIMIT OR SUSPEND OTHER LEGAL RIGHTS YOU MAY HAVE UNDER THE LAWS OF YOUR STATE (OR COUNTRY OR PROVINCE), SUCH AS THE STATUTORY WARRANTY RIGHTS UNDER EU CONSUMER LAW. FOR A FULL UNDERSTANDING OF YOUR RIGHTS, YOU SHOULD CONSULT THE LAWS OF YOUR STATE, COUNTRY, OR PROVINCE.
2. WARRANTY PERIOD
divePRO S.A. ("divePRO") warrants that the divePRO hardware product ("Device") and accessories contained in the original packaging are free from defects in materials and workmanship under normal use. The Warranty Period starts from the date of original retail purchase by the end-user purchaser and lasts for:
- Two (2) Years: For the main divePRO Device (including depth/pressure sensors).
- One (1) Year: For accessories and consumable parts included in the box, such as straps, cables, and chargers.
3. WHAT IS COVERED
During the Warranty Period, if a defect arises in materials or workmanship, divePRO will, at its sole option:
(i) Repair the Device at no charge using new or previously used parts that satisfy divePRO’s quality standards;
(ii) Replace the Device with a new or separate divePRO Recertified device that meets divePRO’s quality standards; or
(iii) Refund the purchase price of the Device upon its return.
Any replacement product or part assumes the remaining warranty of the original Device or ninety (90) days from the date of replacement or repair, whichever provides longer coverage.
4. EXCLUSIONS (WHAT IS NOT COVERED)
This Warranty Policy does not apply to:
(a) Environmental & Thermal Damage: Damage caused by exposure to extreme temperature changes, steam baths, saunas, hot tubs, or by improper storage (e.g. leaving the device in direct sunlight in a vehicle).
(b) Cosmetic Damage: Scratches, nicks, dents, and broken plastic on ports, including alteration of the color and/or material of non-metallic straps (such as rubber, silicone, or textile) due to normal wear and tear and aging.
(c) Consumable Parts: Batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship.
(d) Water Resistance Aging: Water resistance is not a permanent condition and may be affected by the aging of gaskets or by accidental shocks. This warranty does not cover water damage resulting from failure to perform annual inspections or maintenance checks recommended by divePRO.
(e) Underwater Operation: Damage caused by activating buttons, crowns, or opening ports while submerged is not covered, unless specifically allowed in the User Manual.
(f) User Error & Accidents: Damage caused by accident, abuse, misuse, fire, earthquake, or other external causes (e.g., dropping the device).
(g) Water Damage due to Negligence: Damage caused by failure to properly close ports, seal caps, or maintain water-tightness according to divePRO’s instructions (e.g., flooding due to hair/sand in the O-ring).
(h) Chemicals: Damage caused by exposure to chemicals, including but not limited to mosquito repellents, sunscreens, perfumes, or cleaning solvents.
(i) Unauthorized Service: Damage caused by service (including upgrades and expansions) performed by anyone who is not an authorized service provider of divePRO.
(j) Modifications: A product that has been modified or altered without the written permission of divePRO.
(k) Software: divePRO does not warrant that the operation of the Device or its software (Firmware/App) will be uninterrupted or error-free. This warranty applies only to hardware.
(l) Failure to Update: Defects or malfunctions caused by the failure to install mandatory firmware or software updates provided by divePRO to enhance product stability.
(m) Commercial Use: The Device is intended for recreational diving. This warranty does not cover damages or defects arising from intensive commercial, professional, industrial, or military use (e.g. commercial hull cleaning, daily professional instruction), unless a specific commercial warranty has been agreed upon in writing.
5. IMPORTANT RESTRICTIONS
Online Auctions: Products purchased through online auctions are not eligible for warranty coverage. Online auction confirmations are not accepted for warranty verification.
Authorized Resellers: divePRO reserves the right to reject warranty claims for products purchased from unauthorized resellers.
Data Loss: YOU SHOULD MAKE PERIODIC BACKUP COPIES OF THE INFORMATION CONTAINED ON THE DEVICE. During warranty service, the contents of the storage media will be deleted and reformatted. divePRO is not responsible for any loss of dive logs, software programs, or data. Any personal data handled during the warranty service will be processed in accordance with divePRO’s Privacy Policy.
6. SAFETY DISCLAIMER (CRITICAL FOR DIVING)
The divePRO Device is intended to be used only as a supplementary travel and dive aid. It must not be used as a primary source of survival or for purposes requiring precise measurement of direction, distance, location, or topography regarding life-safety. Users must always carry a backup dive computer and/or dive tables and timing devices. divePRO makes no warranty as to the accuracy or completeness of map or depth data in critical life-safety situations.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIVEPRO EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES AND REMEDIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT SHALL DIVEPRO BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, WHETHER RESULTING FROM THE USE, MISUSE, OR INABILITY TO USE THIS PRODUCT OR FROM DEFECTS IN THE PRODUCT (INCLUDING LOSS OF DATA, LOSS OF DIVE TIME, TRAVEL EXPENSES, LOSS OF PROFITS, LOSS OF REVENUE, OR BUSINESS INTERRUPTION).
DIVEPRO IS NOT RESPONSIBLE FOR DAMAGE TO ANY SMARTPHONES, COMPUTERS, OR OTHER ELECTRONIC DEVICES USED IN CONNECTION WITH THE DIVEPRO PRODUCT.
8. HOW TO OBTAIN WARRANTY SERVICE
Before seeking warranty service, please access and review the online help resources available at our knowledge base. If your device is still not functioning properly, please contact us at support@divepro.gr.
- Proof of Purchase: An original or copy of the sales receipt from the original retailer is required.
- Shipping Costs: If you seek warranty service, you may be responsible for shipping charges to the divePRO Authorized Service facility, except where prohibited by applicable mandatory consumer law.
- Processing Time: Please allow approximately 4 to 6 weeks from the date we receive your package for your device to go through the diagnostic and repair process.
9. COUNTRY-SPECIFIC TERMS
For Australian Consumers:
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits under our Warranty Policy are in addition to other rights and remedies under applicable law in relation to the products.

10. GENERAL PROVISIONS
- Governing Law & Jurisdiction: This Warranty Policy shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law principles. Any dispute arising out of or in connection with this Warranty Policy shall be subject to the exclusive jurisdiction of the competent courts of Athens, Greece.
- Non-Transferability: This warranty is extended only to the original end-use purchaser and is strictly non-transferable and non-assignable to any subsequent owner or other party.
- Severability: If any provision of this Warranty Policy is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the legality, validity, and enforceability of the remaining provisions shall not be affected or impaired thereby.
